This website is operated by Pure.Gallery SIA. Throughout the Site, the terms “we”, “us” and “our” refer to Pure.Gallery SIA.

Pure.Gallery offers this website, including the information, tools, customization features, products and services available through it (collectively, the “Services”), subject to these Terms of Service.

By visiting our Site, using our Services or purchasing something from us, you agree to these Terms of Service and any policies referenced in them, including our Privacy Policy and Refund Policy.

Please read these Terms carefully before using the Site.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that enables us to offer our products and Services.

SECTION 1 - ONLINE STORE TERMS

You may use our Site and Services only for lawful purposes and in accordance with applicable law.

You may not use our products or Services for any illegal or unauthorized purpose, violate the rights of others, transmit malicious code, or interfere with the operation or security of the Site.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse or limit use of the Services where reasonably necessary, including where we suspect fraud, unlawful activity, abuse of the Services, infringement of third-party rights, or violation of these Terms.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection law.

SECTION 3 - INFORMATION ON OUR SITE

We make reasonable efforts to ensure that product descriptions, prices and other information displayed on the Site are accurate.

Occasionally, information may contain typographical errors, inaccuracies or omissions. Where permitted by law, we may correct such errors and update information.

Nothing in this section limits our obligations regarding products that do not conform to the contract or your statutory consumer rights.

SECTION 4 - PRICES AND CHANGES TO THE SERVICES

Prices may change from time to time.

The price applicable to your purchase will be the price presented to you at checkout when your order is placed, subject to correction of obvious errors where permitted by applicable law.

We may modify, suspend or discontinue features or parts of the Site from time to time.

SECTION 5 - PRODUCTS AND CUSTOM-MADE PRODUCTS

Certain products are created specifically according to information, photographs, artwork, text, selections or other instructions provided by the customer.

These may include personalized ceramic tiles, personalized posters and other custom-made products.

Custom-made and clearly personalized products are generally not eligible for cancellation or return simply because you change your mind where an exception to the statutory right of withdrawal applies under applicable law.

This does not affect your rights if an item is defective, damaged, incorrect or otherwise does not conform to the contract.

Product previews and customization

Our customization tools may allow you to upload photographs or other content and create or generate a preview before ordering.

You are responsible for reviewing the customization, spelling, names, dates, image selection, cropping and other customer-selected elements before submitting your order.

Because our products are physical items, reasonable differences may occur between an on-screen preview and the finished product, including minor variations in colour, cropping, positioning, texture or appearance resulting from different screens, materials and manufacturing processes.

These normal production variations do not affect your statutory rights where a product is materially defective, incorrect or does not conform to what was agreed.

Order cancellations

Production of personalized products may begin shortly after an order is placed.

If you wish to change or cancel a personalized order, please contact us as soon as possible. If production has not yet begun, we may be able to make changes or cancel the order.

Once production of a personalized item has begun, cancellation or modification may no longer be possible.

SECTION 6 - ORDERS AND ACCOUNT INFORMATION

We reserve the right to refuse, limit or cancel an order for legitimate reasons, including suspected fraud, payment problems, obvious pricing errors, technical errors, prohibited content or suspected unlawful activity.

If we cancel an order after payment has been received and no product is supplied, we will refund the relevant amount.

You agree to provide accurate and complete information required to process your order and deliver your products.

Please review your shipping address and personalization details carefully before submitting an order.

SECTION 7 - SHIPPING

Estimated delivery times shown on the Site are estimates unless expressly stated otherwise.

Shipping may be provided by third-party postal, courier or fulfilment providers.

We are not responsible for delays caused by events outside our reasonable control, but nothing in these Terms limits any mandatory rights you may have if an order is not delivered within the period required by applicable law.

SECTION 8 - THIRD-PARTY SERVICES AND LINKS

Our Services may rely on or provide access to third-party services, including ecommerce, payment, shipping, analytics, image-processing, customization and other technology providers.

Third-party websites and services that are not controlled by us may be subject to their own terms and privacy policies.

We are not responsible for the independent practices or content of third-party websites that we do not control.

SECTION 9 - USER UPLOADS AND CUSTOM CONTENT

Our Services may allow you to upload photographs, artwork, images, text, instructions or other material (“Uploaded Content”) for the purpose of creating or purchasing personalized products.

Your rights to Uploaded Content

By uploading content, you confirm that you have the rights, permissions or other lawful authority necessary for us to use that content for the purposes requested by you.

You must not knowingly upload content that:

infringes copyright, trademark, privacy, publicity or other rights of another person;
is unlawful;
contains malicious software or code;
is submitted for fraudulent or abusive purposes; or
otherwise violates applicable law.

Permission to process your content

You retain any rights you have in your Uploaded Content.

By submitting Uploaded Content to our Services, you grant us a limited, non-exclusive licence to host, copy, modify, process, reproduce and transmit that content only to the extent reasonably necessary to:

provide the customization or generation features you request;
create product previews;
produce and fulfil your personalized order;
provide customer support or reprints;
operate and secure the Services;
comply with legal obligations; and
resolve disputes or protect our legitimate rights.

This permission also allows us to use service providers acting on our behalf where necessary to perform these functions.

It does not transfer ownership of your Uploaded Content to Pure.Gallery.

Automated processing and generation tools

Some customization features may use automated image-processing or artificial intelligence technologies.

Generated results may vary, and the same input may not always produce identical results.

Where a preview is shown before purchase, you should review the selected result before submitting your order.

Content moderation

We may use automated or manual safety and moderation measures.

We may reject or remove content, decline generation requests or cancel orders where we reasonably believe that the content violates these Terms, applicable law, third-party rights or our applicable safety requirements.

Where an order is cancelled by us and no product is supplied, any refund due will be handled in accordance with applicable law and our Refund Policy.

Responsibility for Uploaded Content

You are responsible for content that you knowingly submit and for ensuring that you have the necessary rights to use it.

Where permitted by applicable law, you may be responsible for losses or claims resulting from your unlawful or infringing use of third-party content.

Nothing in this section imposes liability on you beyond what is permitted under applicable law.

SECTION 10 - COMMENTS, REVIEWS AND FEEDBACK

If you voluntarily provide reviews, suggestions, ideas or other feedback concerning our products or Services, you grant us permission to use that feedback for legitimate business and promotional purposes.

This provision does not apply to private photographs or other Uploaded Content submitted solely for creating personalized products, which is governed by Section 9.

SECTION 12 - ERRORS AND INACCURACIES

Occasionally, our Site may contain errors or omissions concerning product descriptions, pricing, promotions, shipping charges, availability or other information.

We may correct genuine errors and inaccuracies where permitted by applicable law.

If an error materially affects an order you have already placed, we will contact you where appropriate.

SECTION 13 - PROHIBITED USES

You must not use the Site or Services:

for unlawful purposes;
to violate intellectual property, privacy or other rights;
to submit fraudulent or materially misleading information;
to distribute malicious code;
to interfere with security or operation of the Services;

Nothing in these Terms excludes or limits liability where it cannot legally be excluded or limited.

In particular, nothing in these Terms limits your mandatory consumer rights relating to defective, damaged, incorrect, unsafe or non-conforming products.

If your intentional or unlawful use of our Services or Uploaded Content infringes the rights of another person and results in a claim against us, you may be responsible for losses reasonably resulting from that conduct to the extent permitted by applicable law.

Nothing in this section creates obligations for consumers beyond those permitted by applicable law.

The current version will be published on this page with an updated revision date.

Changes will not retroactively reduce rights relating to orders already concluded where such changes would not be permitted by applicable law.
